BOOKING AGREEMENT for Portrait Session
(not wedding)
This agreement is between the client booking the photography session (hereinafter referred to as the "Client"), and Julie Patterson Photography, herein after referred to as the "Photographer"
Cancellation:
A non refundable booking fee is due on receipt of booking form. This includes a 14 day cooling off period after payment in which the client is entitled to a refund if they choose to cancel the booking. The remaining balance for the session is due on the or before the day. No images will be edited until full payemnt is recieved. If extras are added on the day of the photo shoot, payments must be paid immediately.
Entire Agreement:
This agreement contains the entire understanding between the Client and the Photographer.
Cooperation:
The Client and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. Unless otherwise noted, Julie Patterson Photography, it's associates will be the exclusive photographer(s) at the agreed photography session. Clients must also notifythe Photographer in writing if they wish to have anything photographed in a particular way. Julie Patterson Photography or the photographer(s) will not be held accountable for not photographing desired portraits, if there is no one to assist in identifying these particular details and photographs on the day. Julie Patterson Photography is not responsible if key individuals fail to appear or cooperate during photography, or for missed images due to details not revealed to Julie Patterson Photography or beyond the photographer(s) control.
House Rules:
Clients agree and understand that Julie Patterson Photography is limited by the guidelines of the location site/venue management/government rules and clients agree to accept the results that may occur from said guidelines. Negotiation with the officials/management for moderation of guidelines is solely the clients responsibility. If client appears under the influence of alcohol or drugs during the shoot, Julie Patterson Photography has the right to cancel the shoot immediately due to public liability and health and safety concerns.
Copyright Law: The copyright of photographs remains with the Photographer. The Photographer grants the Clients permission to make copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographer. Alternation of any images handed to the client is strictly forbidden by anyone other than the original photographer, you may not pass copies of any images to any other professionals without the prior consent of your photographer, and then if permission is granted only small file watermarked versions can be shared and the said professionals must link back to www.juliepatterson.co.uk
RAW images will remain the property of the photographer and cannot be transferred to the client or purchased.
Model Release: The Client grant the Photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the Client for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Client hereby release the Photographer and its legal representatives, heirs and assigns from all liability and claims in connection with the images.
Editing:
Your photographer has full rights to make the selection of the images that she feels are the images that refelct her style and quality of work, during the image selection process any images that are not suitable for selection are removed and not available to the client, your photographer is allowed to have full artistic licence with editing.
Alternation of any images handed to the client is strictly forbidden by anyone other than the original photographer, If any re-edits are required after images are handed over two images can be re-edited free of charge.
Editing time after the session can be up to 5 weeks but is often less, the digital files are available to download as soon as purchased or chosen, the client must BACKUP their photos, the Photographer cannot be held responsible for loss.
Retouching:
It is not possible for your photographer to know how you prefer to look, the photographer can not spend the time editing appearences. Such as hair, make up and body shape etc. Please ensure you look the way you would like to in the photos before they are taken.
Sale Items:
Julie Patterson Photography reserves the right to reduce the cost of sessions or digital files at times throughout the year as an "offer" or "sale" if you have paid full price for a session or digital files at another date it is not possible to then receive the discounted price for items previously purchased at an earlier date, this includes (but not limited to) gift vouchers and advance bookings.
Limit of Liability:
If a photographer is too ill or becomes injured and cannot attend your session another alternative date can be arranged, and the photographer cannot be held liable for any loss of earnings incurred for missed sessions and will reschedule to a session that suits the client.
Julie Patterson Photography takes the upmost care with respect to exposure, storage, and processing the photographs/images, but cannot and does not, guarantee that photographs/images of the event will not be lost, stolen, or destroyed for reasons within or beyond Julie Patterson Photography's control.
The client agrees that Julie Patterson Photography or the photographer(s) full and complete responsibility and liability is limited to the return of all payments received for the event.
Gift Vouchers:
Gift vouchers are non refunable but are transferable.
Cancellation:
In the event of the Client cancelling the session for whatever reason prior to the session the booking fee of £30 is non-refundable. It will be considered as liquidated damages to the Photographers, if the session is cancelled with less than 48 hours notice the full session fee is required in full.
If your session has to be cancelled due to anything happening to baby during pregnancy or serious condition your session less costs incurred will be refunded.
If an outdoor session has to be rearranged due to the weather I will do my upmost to fit you in on another date, if you choose not to move and request a refund £30 of your fee is retained for holding the date, the weather isnt something I can control.
We have understood the contents of this contract and agree to the terms therein.
